Legacy Funding is a small business marketplace designed to help small businesses access and manage capital. Everyone who uses our Sites is subject to our Privacy Policy.

  5. Providers of Third-Party Services: Customers of Legacy Funding who use certain of our products are subject to third-party privacy policies.

Lenders and/or brokers.

By registering for our services or submitting a request for a business loan product or service as described on the sites, you indicate your willingness to proceed and that you consent, acknowledge, and agree to the disclosure of your information to lenders and/or brokers in our network. We will not run a credit check without your permission. Please be aware that the lenders, brokers, and/or other service providers with whom you are matched and who receive your information may keep your information even if you do not enter into an agreement for their products or services. Please contact each of these parties directly to inquire about their privacy and information policies. In addition, if you enter into an agreement with a lender, broker, or another service provider through the Legacy Funding service and change the information you provided to us, we may share the updated information with such lenders, brokers, and/or service providers.

Disclosure to Trusted Third Parties By Us:

We will share your information with third-party service providers with whom you are matched after you complete a profile on the site and fill out the entirety of the application. Our partner’s page contains a list of those companies. By accepting the Terms of Service, you agree to receive marketing materials from third parties we trust, such as potential lenders and service providers. We are not liable for the content or actions of third-party websites. Your information may also be shared with third-party contractors who provide Legacy Funding with services and are subject to this privacy policy. Such third parties will treat your information as private and confidential, and it will not be used for any purpose other than what you authorize. Furthermore, from time to time, we may share personal information (such as e-mail or mailing address) about our user base with carefully selected third parties in order for them to offer goods and services that we believe our users may be interested in.

You can deactivate your account if you no longer want to use it. When you deactivate an account, your information is not sent to any additional lenders, brokers, or other third parties, but it is not deleted. By deactivating your account, you will be able to restore the entire account.

In certain circumstances, you may delete your Legacy Funding account by submitting a deletion request to Legacy Funding. Legacy Funding is legally required to keep the information in your account in certain circumstances. Legacy Funding will deactivate your account, opt you out of all communications, and disable your access to the account in these circumstances.

If Legacy Funding is able to comply with your request to delete your account, the data you provide to Legacy Funding will be retained in a commercially reasonable manner and in accordance with applicable lending laws. Legacy Funding will not share your information after your account is deleted, and will only use your data for internal research and Legacy Funding marketing. Legacy Funding will keep data for a commercially reasonable period of time, as determined by Legacy Funding in accordance with applicable law.

We securely store your personal information for the duration of your Legacy Funding Account. We will only keep your personal information for as long as is necessary to fulfill the purposes for which it was collected, such as meeting any legal, accounting, or reporting obligations or resolving disputes. While retention requirements vary by jurisdiction, we have provided information about our typical retention periods for various aspects of your personal information below.

Personal information collected to meet our legal obligations under financial, consumer protection, and commercial credit laws may be retained after account closure for as long as such laws require.

Contact For marketing purposes, information such as your name, email address, and phone number are kept on file until you unsubscribe. Following that, we will add your information to our suppression list to ensure that we do not market to you inadvertently.

If, after signing up for our services, you decide you no longer want to receive our services or future contact from lenders, brokers, or other third parties to whom your information has been forwarded, you may cancel your account as described below. Your information will no longer be sent to lenders, brokers, or other third parties after you cancel your account. This does not mean that these lenders, brokers, or other third parties will no longer contact you or use your information. Please contact all lenders, brokers, and/or other third parties to request that they stop contacting you.

Certain federal and state regulations require us to keep a record of your information for specific time periods. We may be unable to completely delete your information from our database due to these regulations until the time requirements of these regulations have expired.

Depending on state and federal laws, you may be able to exercise certain rights regarding your personal information.

Depending on the applicable law in your jurisdiction, you may be able to assert the following rights regarding your personal information. If any of the following rights are not provided by law for your operating entity or jurisdiction, Legacy Funding has complete discretion in granting you those rights.

If you close your Legacy Funding Account, we will mark your account as “Closed” in our database, but we will retain certain account information, including your request to erase it, in our database for the time period described above. This is necessary to deter fraud by ensuring that individuals attempting to commit fraud cannot avoid detection simply by closing their account and opening a new account, as well as to comply with Legacy Funding’s legal obligations.
