Legacy Funding is a small business marketplace designed to help small businesses access and manage capital. Everyone who uses our Sites is subject to our Privacy Policy.

By accepting Legacy Funding’s Terms of Service and accessing, browsing, or using our Sites, you agree to this Privacy Policy. If we need your permission to process your personal information, we will ask for your permission to collect, use, and disclose your personal information as described further below. Full name, date of birth, demographic information (e.g., nationality, gender), signature, utility bills, photographs, phone number, home address, IP address, social security number, and/or email are examples of personal identification information.
Formal Identification Information: Any government-issued identity document, such as a passport, driver’s license, national identity card, state identification card, tax ID number, passport number, driver’s license details, national identity card details, visa information, and/or any other information deemed necessary to comply with our legal obligations under financial, consumer protection, and commercial lending laws.
Employer Identification Number (or comparable number issued by a government), proof of legal formation (e.g. Articles of Incorporation), and personal identification information for all material beneficial owners are all examples of institutional information.
Financial Information: Bank account information, Tax return information, Federal and State Tax identification numbers, profit and loss statements, income statements, credit scores, business invoices, and wire instructions are all required.
Transaction Information: Information about the transactions you conduct on our Services, such as the recipient’s name, your name, the amount, and/or the timestamp.
Employment information includes office location, job title, and/or role description.
Correspondence includes survey responses and information provided to our customer service or user research teams.
Type of business, list of officers, members, or managers, articles of incorporation, certificates of good standing, and ownership structure are all examples of business information. To fulfill our service obligations to you, you grant Legacy Funding permission to share any and all information provided to or obtained by Legacy Funding on your behalf with lenders, with other businesses who may require this information to fulfill Legacy Funding’s services, for Legacy Funding’s business purposes, or to meet regulatory or other legal requirements. We will not, under any circumstances, disclose, transmit, or share these documents without your permission, unless required to do so by law or regulation.

2.2 Information We Collect From You Automatically

For a variety of reasons, we collect information about your computer’s interactions with our Sites.

We automatically receive and store certain types of information, such as when you interact with the Sites or use the Services. This information assists us in resolving customer service issues, improving the performance of our Sites and applications, providing you with a more streamlined and personalized experience, and protecting your account from fraud by detecting unauthorized access. Advertising Networks and Analytics Service Providers: We collaborate with these providers to obtain de-identified information about how you found our Sites and how you interact with them. This information may be gathered prior to the creation of an account.
Providers of Third-Party Services: Customers of Legacy Funding who use certain of our products are subject to third-party privacy policies.

2.4 Data Anonymization and Data Aggregation

We may use anonymized and aggregated data for any business purpose.

Anonymization is a data processing technique that removes or modifies personal information so that it can no longer be linked to a specific person. Except for this section, none of this Privacy Policy’s other provisions apply to anonymized or aggregated customer data (i.e. information about our customers that we combine together so that it no longer identifies or references an individual customer).

We may also require your company’s name, address, federal and state tax ID, type of business, business location, average monthly sales, state of incorporation, and landlord’s name. Emails and phone calls: When you register for our services, we ask for your email address. We use your email for both transactional and promotional purposes (e.g., newsletters, new product offerings, event notifications, and special third-party offers). Our e-mail messages may contain code that allows our database to track your usage of the e-mails, such as whether the email was opened and what links (if any) were clicked. We reserve the right to send you Legacy Funding-related communications, such as service announcements and administrative messages, without offering any compensation. We may also contact you by phone or text message (including any wireless number you provide to us) solely to provide Legacy Funding’s services. If you do not want to receive phone calls or text messages from us, you can change or delete your phone number from your account preferences page(s), or ask to be removed from our contact list if you receive one.
Log files: When you visit one of our Sites, our servers automatically collect information from your browser (such as your IP address, browser type, Internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and a number of clicks) in order to analyze trends, administer the site, prevent fraud, track visitor movement in aggregate, and gather broad demographic information. IP addresses are recorded in order to track a user’s session. This helps us understand which parts of our website users are visiting. We do not share the log files with anyone else.
Cookies: We use “cookies” to store certain types of information while you visit our Sites or use our services. 4. How Your Information Is Used

We use your information for a number of purposes, all of which benefit Legacy Funding’s Sites and Services.

We process your personal information in order to provide you with Legacy Funding services. For example, if you want to seek business financing from one of our financing partners, we’ll need information like your identification, contact information, and income. We cannot provide you with services unless you provide us with this information.

To provide Service communications: We send you administrative or account-related information to keep you up to date on our Services, to notify you of relevant security issues or updates, or to provide other transaction-related information. Without such communications, you may be unaware of important account developments that may affect how you use our Services. You cannot choose not to receive critical service communications, such as emails or mobile notifications sent for legal or security reasons.
To provide customer service: When you contact us to resolve any questions, or disputes, collect fees, or troubleshoot problems, we process your personal information. We cannot respond to your requests and ensure your uninterrupted use of the Services unless we process your personal information for such purposes.

Lenders and/or brokers.

By registering for our services or submitting a request for a business loan product or service as described on the sites, you indicate your willingness to proceed and that you consent, acknowledge, and agree to the disclosure of your information to lenders and/or brokers in our network. We will not run a credit check without your permission. Please be aware that the lenders, brokers, and/or other service providers with whom you are matched and who receive your information may keep your information even if you do not enter into an agreement for their products or services. Please contact each of these parties directly to inquire about their privacy and information policies. In addition, if you enter into an agreement with a lender, broker, or another service provider through the Legacy Funding service and change the information you provided to us, we may share the updated information with such lenders, brokers, and/or service providers.

Disclosure to Trusted Third Parties By Us:

We will share your information with third-party service providers with whom you are matched after you complete a profile on the site and fill out the entirety of the application. Our partner’s page contains a list of those companies. By accepting the Terms of Service, you agree to receive marketing materials from third parties we trust, such as potential lenders and service providers. We are not liable for the content or actions of third-party websites. Your information may also be shared with third-party contractors who provide Legacy Funding with services and are subject to this privacy policy. Such third parties will treat your information as private and confidential, and it will not be used for any purpose other than what you authorize. Furthermore, from time to time, we may share personal information (such as e-mail or mailing address) about our user base with carefully selected third parties in order for them to offer goods and services that we believe our users may be interested in.

With contracted service providers who assist with various aspects of our business operations. 6. Updating, Accessing, Retaining, And Deleting Your Information

You have the option to update, access, or delete your data; however, we may be required by law to retain your information in order to comply with the law.

You can change or update your contact information at any time by logging into your account and making the necessary changes. Any changes will be reflected immediately.

You can deactivate your account if you no longer want to use it. When you deactivate an account, your information is not sent to any additional lenders, brokers, or other third parties, but it is not deleted. By deactivating your account, you will be able to restore the entire account.

In certain circumstances, you may delete your Legacy Funding account by submitting a deletion request to Legacy Funding. Legacy Funding is legally required to keep the information in your account in certain circumstances. Legacy Funding will deactivate your account, opt you out of all communications, and disable your access to the account in these circumstances.

If Legacy Funding is able to comply with your request to delete your account, the data you provide to Legacy Funding will be retained in a commercially reasonable manner and in accordance with applicable lending laws. Legacy Funding will not share your information after your account is deleted, and will only use your data for internal research and Legacy Funding marketing. Legacy Funding will keep data for a commercially reasonable period of time, as determined by Legacy Funding in accordance with applicable law.

We securely store your personal information for the duration of your Legacy Funding Account. We will only keep your personal information for as long as is necessary to fulfill the purposes for which it was collected, such as meeting any legal, accounting, or reporting obligations or resolving disputes. While retention requirements vary by jurisdiction, we have provided information about our typical retention periods for various aspects of your personal information below.

Personal information collected to meet our legal obligations under financial, consumer protection, and commercial credit laws may be retained after account closure for as long as such laws require.

Contact For marketing purposes, information such as your name, email address, and phone number are kept on file until you unsubscribe. Following that, we will add your information to our suppression list to ensure that we do not market to you inadvertently.

The content you post on our website, such as support desk comments, photographs, videos, blog posts, and other content, may be retained after you close your account for audit and crime prevention purposes (e.g. to prevent a known fraudulent actor from opening a new account).

8. Choice/Opt Out Of Marketing

You have the option to stop using our services.

You may choose not to provide us with certain information, but doing so will most likely prevent you from using certain features of the site and obtaining the services and products you seek. If, after signing up for our services, you decide you no longer want to receive our services or future contact from lenders, brokers, or other third parties to whom your information has been forwarded, you may cancel your account as described below. Your information will no longer be sent to lenders, brokers, or other third parties after you cancel your account. This does not mean that these lenders, brokers, or other third parties will no longer contact you or use your information. Please contact all lenders, brokers, and/or other third parties to request that they stop contacting you.

Certain federal and state regulations require us to keep a record of your information for specific time periods. We may be unable to completely delete your information from our database due to these regulations until the time requirements of these regulations have expired.

If you close your Legacy Funding Account, we will mark your account as “Closed” in our database, but we will retain certain account information, including your request to erase it, in our database for the time period described above. This is necessary to deter fraud by ensuring that individuals attempting to commit fraud cannot avoid detection simply by closing their account and opening a new account, as well as to comply with Legacy Funding’s legal obligations.
